User Agreement and Code of Conduct

This User Agreement and Code of Conduct (this “Agreement”) governs your access to and use of the Violette platform, including any website, mobile application, Circle, Hub, direct messaging feature, AI-assisted onboarding feature, profile tool, community feature, and related service operated by Tript, Inc. d/b/a Violette (“Violette,” “we,” “us,” or “our”).

By creating an account, clicking to accept, or accessing or using Violette, you agree to this Agreement. If you do not agree, do not use the platform.

This Agreement supplements, and must be read together with, Violette's Terms of Use, Privacy Notice, Cookies and Similar Technologies Policy, and AI Use Disclosure, each as updated from time to time. Those documents are incorporated into this Agreement by reference. If there is a conflict between this Agreement and another Violette policy or notice, the stricter rule or the rule more protective of safety, privacy, legal compliance, or platform integrity will govern to the extent permitted by law.

I. User Agreement

Article 1: Adult Platform; Intended Use

Violette is an adults-only platform intended to support intentional community, conversation, and connection around lawful interests and topics. You must be at least eighteen (18) years old, or the age of legal majority where you live if higher, to use Violette.

Violette is a technology platform, not a medical provider, mental health provider, crisis service, legal advisor, or emergency response service. The platform, including Vi and any other AI-enabled feature, does not provide medical, psychiatric, therapeutic, legal, financial, or emergency advice. If you are in immediate danger or experiencing an emergency, contact local emergency services.

Article 2: Account, Identity, and Security

You agree to provide accurate, current, and complete account information and to keep it updated. You are responsible for activity under your account and for keeping your login credentials secure.

You may not share your account with another person, impersonate another person, or create an account using false, misleading, or unauthorized information. Violette may require age verification, identity verification, or additional account information where reasonably necessary for security, fraud prevention, legal compliance, trust and safety review, or enforcement.

You must notify Violette promptly at support@violette.com if you believe your account has been accessed without authorization or otherwise compromised.

Article 3: AI-Assisted Experience

Violette may use AI-enabled tools, including Vi, to help build your profile, remember relevant information from your interactions, personalize your experience, generate suggestions, support safety workflows, and connect you with other users, hubs, or circles that may match your interests.

You understand and agree that:

  • Vi and other AI-enabled features are a core part of the Violette experience;
  • Violette may retain and use relevant interaction history for matchmaking, personalization, safety, support, model improvement, and service improvement as described in Violette's Privacy Notice and AI Use Disclosure;
  • AI outputs may be incomplete, inaccurate, irrelevant, biased, or inappropriate;
  • you remain solely responsible for decisions you make based on AI outputs or recommendations; and
  • you will not rely on AI outputs as professional advice or emergency guidance.

Your use of AI-enabled features is also subject to Violette's Terms of Use, Privacy Notice and AI Use Disclosure.

Article 4: Privacy, Encryption, and Product Architecture

Violette seeks to collect and use only the information reasonably needed to operate the platform, support intentional community, maintain security, comply with law, and improve the service.

Different parts of Violette have different visibility and moderation characteristics. In general:

  • Certain platform areas, including Hubs and account-level interactions, may be visible to Violette and may be reviewed for operations, safety, support, legal compliance, and improvement; and
  • Circles are designed as more private spaces and use encryption to help protect content against outside threats and unnecessary exposure. Encryption in Circles works like this:
    • Your private content on Violette is encrypted at rest so it is never stored in plain, readable form in our database. Direct messages, Circles, and every conversation is protected so that access to one space should never grant access to another.
    • A database snapshot alone should never reveal anything usable. The keys required to read your content live only briefly in protected memory and are designed not to be able to be reconstructed by a database administrator on their own.
    • While this safeguards your content against unauthorized access at the storage layer, Violette can still process your content as needed to operate the Services.

Encryption is an important privacy and safety feature, but it does not make the platform blind in all circumstances and does not guarantee that no one else can copy, share, screenshot, record, or disclose what you send. Violette may review content that is reported, forwarded, or otherwise made available through user reports, support requests, legal process, or other lawful means.

You understand that even where content is encrypted or not ordinarily visible to Violette, Violette may still process metadata, technical logs, device and account information, and related signals needed to operate the platform, maintain security, investigate abuse, and comply with law.

Your use of the platform is also subject to Violette's Privacy Notice and Cookies Policy, which describe how Violette collects, uses, stores, transfers, and discloses information.

Article 5: Special Terms for Circles

Circles are intended to offer a more private, candid, and intentional environment for conversation than more visible parts of the platform. Violette offers circles to support trust, openness, and community intimacy, and the encrypted design of circles is intended to reduce unnecessary exposure of message content.

By using a Circle, you understand and agree that:

  • encryption in a circle is a privacy-enhancing feature, not a guarantee of secrecy, anonymity, or immunity from consequences;
  • other participants in a circle may still view, copy, retain, screenshot, record, summarize, or disclose what you share;
  • Violette may have limited or no ordinary access to the substance of circle content unless that content is reported, forwarded, voluntarily shared, legally compelled, or otherwise made available through lawful means;
  • Violette may still collect or process circle-related metadata, participation records, timestamps, device and account signals, and technical logs needed to operate the platform, maintain safety, investigate misuse, and comply with law;
  • moderation and enforcement in circles may depend substantially on user reporting rather than proactive review of message content; and
  • if you require a communication channel that no platform operator can under any circumstances access, recover, or review, Violette may not be the appropriate channel for that use case.

You agree to use heightened judgment in circles and not to assume that all statements made by other users are accurate, safe, lawful, or trustworthy.

Article 6: Cross-Border Data Handling

Violette is a Delaware corporation with its principal place of business in Pennsylvania. Violette may use infrastructure, hosting, service providers, and sub-processors in the United States, the Netherlands, the European Economic Area, the United Kingdom, and other jurisdictions.

By using Violette, you acknowledge that your information may be stored, processed, backed up, or transferred across jurisdictions, including on servers located in the Netherlands, subject to Violette's Privacy Notice and applicable law. Where required by law, Violette will implement appropriate safeguards for cross-border transfers.

Article 7: Your Content and Your Commitments

You are solely responsible for the content you post, share, upload, transmit, or otherwise make available through Violette, including in hubs, circles, profiles, direct messages, and any AI or support interfaces.

You agree that you will not use Violette to post, share, store, threaten to share, request, solicit, promote, or facilitate:

  • unlawful content or unlawful activity;
  • harassment, threats, stalking, exploitation, hate, abuse, or coordinated harm;
  • fraudulent, deceptive, or misleading content;
  • child sexual abuse material or any sexual content involving minors;
  • non-consensual intimate visual content;
  • synthetic, altered, manipulated, or AI-generated intimate visual content of an identifiable person without that person's affirmative consent;
  • content or conduct that violates the Take It Down Act or any other applicable law relating to non-consensual intimate imagery or synthetic intimate imagery;
  • instructions, encouragement, or assistance for distributing, threatening to distribute, or monetizing prohibited intimate content; or
  • malware, scraping tools, bots, surveillance tools, or other technical means to interfere with, monitor, harvest from, or abuse the platform or its users without authorization.

You represent and warrant that you have all rights, permissions, and consents needed for any content you post, including any consent required from an identifiable person depicted in intimate, sexual, nude, or otherwise highly sensitive visual content.

You also agree that, in circles, you will not use the privacy-enhancing design of the feature as a shield for misconduct, evasion, concealment of violations, retaliation against reporters, or efforts to frustrate Violette's trust and safety processes.

Your conduct on the platform is also subject to Violette's Terms of Use and Privacy Notice.

Article 8: License to Violette

You retain ownership of the content you submit to Violette, subject to the rights you grant in this Agreement and in Violette's Terms of Use.

You grant Violette a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, process, reproduce, adapt, display, transmit, and otherwise use your content as reasonably necessary to operate, secure, provide, personalize, moderate, improve, and support the platform; enforce Violette's rules; comply with law; and investigate reports, abuse, or security incidents.

This license continues for so long as your content remains on or in Violette's systems, subject to deletion, backup retention, legal preservation, de-identification, and other limitations described in the Privacy Notice or required by law.

For clarity, where a Circle is technically designed so that Violette does not ordinarily have access to message content, this Section does not mean that Violette is representing that it continuously reviews or can freely access all Circle content in the ordinary course.

Article 9: Reporting Obligation for Circles and Sensitive Harms

Because Circles are designed to provide more private and encrypted spaces, Violette may not learn of misconduct occurring in a circle unless a participant reports it. If you encounter content or conduct in a circle that appears to violate this Agreement, the Terms of Use, the Take It Down Act, or other applicable law, you must promptly report it using Violette's in-product reporting tools or by contacting safety@violette.com.

Reports involving non-consensual intimate content, synthetic intimate content, exploitation, threats, impersonation, unlawful conduct, or similarly serious harms should include, if available, enough information for Violette to identify the content, the users involved, the relevant circle or location, and the basis for the report. Depending on the reporting flow and technical architecture, review may require the reported content or related evidence to be provided to Violette.

You agree not to discourage, retaliate against, intimidate, or interfere with any person who makes a good-faith report relating to conduct in a circle or elsewhere on the platform.

Violette may remove content, restrict access, suspend or terminate accounts, preserve available records, and refer matters to law enforcement, the National Center for Missing and Exploited Children where applicable, or other appropriate authorities.

Article 10: Community Safety Floor

Violette supports open, adult discussion and does not operate a broad editorial censorship model for lawful viewpoints or good-faith discussion. At the same time, certain conduct is not permitted anywhere on the platform, regardless of community norms or preferences.

That platform-wide safety floor includes, at minimum, prohibitions on:

  • illegal activity;
  • harassment and sustained abuse;
  • hate or discriminatory violence;
  • exploitation or coercion;
  • platform abuse, fraud, impersonation, or evasion of enforcement;
  • non-consensual intimate content and synthetic intimate content;
  • content that creates a serious risk of harm to others; and
  • sustained failure by community leaders to steward safety within their spaces.

Hub leaders may adopt stricter local rules for their communities, but they may not adopt weaker rules than Violette's platform-wide minimum standards.

Article 11: Reporting, Moderation, and Enforcement

Violette provides reporting avenues and blocking tools so users can flag harm and limit unwanted contact. Reports are reviewed by Violette, which may coordinate with relevant Hub leaders where appropriate.

Outcomes may include warnings, education, content removal, de-indexing, feature restrictions, account restrictions, suspension, termination, or removal of a hub or other community space in serious or repeated cases. Violette does not shadowban users by secretly hiding content while making the user experience appear unchanged.

Because some spaces are more private by design, Violette does not guarantee proactive detection of all harmful or unlawful conduct, immediate response to every report, successful recovery of all content, or complete investigatory visibility into conduct occurring within circles. Users remain responsible for exercising judgment and reporting concerning conduct.

Article 12: Data Requests, Export, and Deletion

Subject to applicable law and technical limitations, you may request access to, export of, correction of, or deletion of certain account information. Data export may be request-based and may exclude encrypted, inaccessible, or technically impracticable content, including certain direct message, group message, or Circle content.

You may request deletion of your account at any time. Violette will process deletion requests in accordance with its Privacy Notice, legal obligations, backup practices, incident-response needs, and operational retention policies. Violette may retain certain data where required or permitted by law, for security, fraud prevention, dispute resolution, legal preservation, backup integrity, or enforcement purposes.

Article 13: Intellectual Property and Use Restrictions

The Violette platform, including its software, design, interfaces, branding, AI systems, and related materials, is owned by or licensed to Violette and is protected by law.

You may use the platform only for its intended purposes and in compliance with this Agreement. You may not copy, scrape, reverse engineer, decompile, benchmark, frame, mirror, or otherwise exploit the platform, its content, or its AI-enabled features except as expressly permitted by Violette or by applicable law.

You may not use Violette content, user content obtained through the platform, or outputs generated through the platform to train, fine-tune, or improve any artificial intelligence, machine learning, or similar model without Violette's prior written consent.

Article 14: Third-Party Services and Providers

Violette may rely on third-party hosting providers, cloud providers, analytics providers, security vendors, AI providers, support vendors, and other service providers to operate the platform. Violette is not responsible for the acts or omissions of third-party services you choose to access separately from the platform, and your use of those third-party services may be governed by their own terms and policies.

Article 15: Service Changes and Availability

Violette may add, remove, suspend, or modify features, communities, AI-enabled functionality, or technical architecture at any time for business, legal, safety, or operational reasons.

Violette does not guarantee uninterrupted availability of the platform or any particular feature, hub, circle, message history, recommendation system, or AI capability.

Article 16: Electronic Consent and Notices

By creating an account, clicking to accept this Agreement, or using the platform, you consent to receive this Agreement, the incorporated Violette policies, disclosures, updates, legal notices, and other communications electronically, including by email, in-app notice, push notification, posted notice, or other reasonable electronic means.

You agree that electronic records and electronic communications satisfy any legal requirement that communications be in writing and that your electronic acceptance is intended to have the same force and effect as a handwritten signature.

You are responsible for maintaining current account and contact information and for reviewing notices Violette provides.

Article 17: Disclaimers

To the maximum extent permitted by law, Violette provides the platform on an “as is” and “as available” basis. Violette disclaims all warranties, whether express, implied, statutory, or otherwise, including any warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement, security, availability, or that the platform will be uninterrupted, error-free, or suitable for your needs.

Violette does not guarantee the behavior, identity, legality, compatibility, intentions, or truthfulness of any user, community, hub leader, or third party.

Article 18: Limitation of Liability

To the maximum extent permitted by law, Violette and its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, use, or other intangible losses arising out of or relating to the platform or this Agreement.

To the maximum extent permitted by law, Violette's aggregate liability for all claims arising out of or relating to the platform or this Agreement will not exceed the greater of: (a) one hundred U.S. dollars (US $100); or (b) the amount you paid to Violette, if any, in the twelve (12) months before the event giving rise to the claim.

Some jurisdictions do not allow certain liability limitations, so parts of this Section may not apply to you.

Article 19: Indemnity

To the maximum extent permitted by law, you will defend, indemnify, and hold harmless Violette, its affiliates, and its and their respective officers, directors, employees, contractors, agents, licensors, and service providers from and against third-party claims, demands, actions, proceedings, liabilities, damages, judgments, settlements, costs, and reasonable attorneys' fees arising out of or relating to:

  • your content;
  • your violation of this Agreement, the Terms of Use, the User Code of Conduct, or applicable law;
  • your infringement or violation of another person's rights, including privacy, publicity, intellectual property, or consent rights; or
  • your misuse of the platform, including misuse involving non-consensual intimate content, synthetic intimate content, fraud, scraping, abuse, unlawful conduct, or misuse of circles to conceal or facilitate violations.

This Section does not require you to indemnify Violette for Violette's own gross negligence, willful misconduct, or violation of law.

Article 20: Governing Law and Dispute Resolution

This Agreement, and any dispute arising out of or relating to this Agreement or the platform, is governed by and incorporates the Dispute Resolution; Binding Arbitration; Class Action Waiver, Governing Law and Venue, and related dispute provisions in Violette's Terms of Use, as updated from time to time.

Without limiting the foregoing, except to the extent applicable federal law governs arbitration issues, Delaware law governs this Agreement and related disputes without regard to conflict of laws principles, and covered disputes must be resolved through the binding arbitration framework set out in Violette's Terms of Use unless an express exclusion applies.

By accepting this Agreement, you acknowledge that you have reviewed or had the opportunity to review those dispute provisions, including the class action waiver and jury trial waiver, and agree to be bound by them.

Article 21: Suspension and Termination

Violette may remove content or suspend or terminate your access to the platform if we reasonably believe you have violated this Agreement, created risk or legal exposure, harmed others, undermined community safety, misused AI-enabled features, or used the platform unlawfully or abusively.

Upon suspension or termination, your right to use the platform will end immediately, but provisions of this Agreement that by their nature should survive will remain in effect, including provisions relating to reporting, moderation, data retention, licenses, disclaimers, liability limitations, indemnity, dispute resolution, and enforcement.

Article 22: Changes to This Agreement

Violette may update this Agreement from time to time. If Violette makes material changes, it will provide notice as required by applicable law, which may include posting an updated version, updating the effective date, providing in-product notice, or sending an email.

Your continued use of the platform after the effective date of an updated Agreement constitutes your acceptance of the revised Agreement, to the extent permitted by law.

Article 23: Miscellaneous

This Agreement, together with the Violette documents incorporated by reference, constitutes the entire agreement between you and Violette regarding the subject matter addressed here, except to the extent Violette provides additional terms for a specific feature, service, promotion, or community.

If any provision of this Agreement is found to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect.

Violette's failure to enforce any provision of this Agreement is not a waiver of that provision or any other provision.

You may not assign, delegate, or transfer this Agreement or any rights or obligations under it without Violette's prior written consent. Violette may assign or transfer this Agreement, in whole or in part, in connection with a merger, acquisition, financing, reorganization, sale of assets, or by operation of law.

II. User Code of Conduct

Violette is designed for adults who want thoughtful, intentional, and lawful community. This User Code of Conduct explains the conduct standards that apply across Violette, including in profiles, hubs, circles, direct messages, AI interactions, events, and off-platform activity that is closely tied to use of Violette.

Article 1: Core Expectations

When you use Violette, you agree to:

  • participate in good faith;
  • treat other people with respect, care, and basic dignity;
  • honor boundaries, consent, and stated preferences;
  • use the platform lawfully;
  • avoid manipulation, coercion, intimidation, or exploitation; and
  • help protect the privacy and safety of others.

Article 2: Privacy and Consent

Violette is built to support intentional community, not surveillance or extraction. You may not:

  • disclose another person's private, personal, or identifying information without authorization;
  • share screenshots, recordings, or copied content from private spaces in ways that violate someone's privacy, consent, or reasonable expectations;
  • attempt to defeat, bypass, probe, or misuse Violette's privacy, encryption, access-control, or security features;
  • impersonate another person or misrepresent your identity, age, affiliation, or intentions; or
  • pressure others to disclose personal, intimate, or sensitive information they do not want to share.

Article 3: Harassment, Hate, and Exploitation

You may not use Violette to:

  • harass, threaten, stalk, dogpile, or intimidate another person;
  • target a person or group based on race, religion, national origin, ethnicity, sex, gender, gender identity, sexual orientation, disability, or other protected status;
  • engage in hateful, degrading, or dehumanizing conduct;
  • groom, exploit, coerce, extort, or manipulate another person; or
  • encourage self-harm, violence, or serious harm against any person.

Article 4: Illegal and Dangerous Conduct

You may not use Violette to promote, facilitate, coordinate, or conceal unlawful conduct. Illegal activity remains prohibited regardless of any user's personal beliefs about whether a law is just or should exist.

You may not use Violette to:

  • facilitate violence, trafficking, exploitation, or abuse;
  • distribute or solicit contraband, illegal services, or unlawful transactions;
  • commit fraud, impersonation, scams, or deceptive practices;
  • evade law enforcement or platform enforcement through alternate accounts, coded conduct, or technical abuse; or
  • post or distribute content that is unlawful to possess or share.

Article 5: Non-Consensual Intimate Content and Synthetic Intimate Content

Violette has zero tolerance for non-consensual intimate content.

You may not post, upload, share, transmit, request, threaten to share, store for distribution, or otherwise use Violette to create, distribute, or facilitate:

  • non-consensual intimate visual content;
  • sexually explicit or intimate images or videos of an identifiable person without that person's affirmative consent;
  • altered, manipulated, morphed, deepfake, AI-generated, or other synthetic intimate content depicting or appearing to depict an identifiable person without that person's affirmative consent;
  • extortion, threats, blackmail, or coercion involving intimate content; or
  • any content or conduct that violates the Take It Down Act or similar laws.

If you see this kind of content, especially in a circle, where Violette may not otherwise know it exists, you must report it immediately by contacting safety@violette.com.

Article 6: Community Spaces, Hubs, and Circles

Different spaces on Violette serve different functions. Hubs may have additional local rules set by their leaders. Circles are designed to support more private and candid discussion and use encryption to better protect participants from outside exposure.

That privacy is a benefit, not a loophole. Circles are still governed by Violette's rules. Because moderation in circles may depend on participant reporting, users are expected to report serious or unlawful misconduct rather than assume Violette will independently detect it.

Article 7: Honest Participation and No Platform Abuse

You may not:

  • create fake accounts or mislead others about who you are;
  • use bots, scraping tools, or automated means to harvest data or monitor users without authorization;
  • interfere with the platform's operation, security, or trust systems;
  • evade suspensions, restrictions, or moderation actions; or
  • use Violette primarily to spam, advertise without authorization, or manipulate engagement.

8. Community Leaders and Stewardship

If you lead a Hub or community on Violette, you take on additional responsibilities. You must:

  • steward your space in good faith;
  • maintain local rules that are at least as protective as Violette's platform-wide floor;
  • respond responsibly to member concerns and safety issues;
  • use any member information available to you only for legitimate community purposes; and
  • keep member data reasonably secure and honor requests to stop non-essential contact where applicable.

Leaders may set stricter norms for their communities, but not weaker ones.

Article 9: Reporting and Cooperation

Use Violette's reporting email at safety@violette.com and blocking features if you experience or observe conduct that may violate this Code. If Violette investigates a report, you agree to cooperate reasonably and honestly.

False reporting, evidence fabrication, or malicious misuse of reporting tools is itself a violation.

Article 10: Enforcement

Violette may take action in response to violations of this Code, including warnings, content removal, education measures, feature limits, account restrictions, suspension, termination, or removal of a hub or other community space.

In serious cases, Violette may preserve evidence and report conduct to law enforcement, the National Center for Missing and Exploited Children where applicable, or other appropriate authorities.

Article 11: No Emergency Service

Violette is not an emergency service. If you or someone else is in immediate danger, contact local emergency services immediately.
